These Terms & Conditions (“Terms”) govern your use of www.ilumayskin.com (the “Website”) and your purchase and use of products offered through it.
The Website is owned and operated by Thirty Thirty Skincare Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at 2, M K Brothers Ind. Estate, Andheri Kurla Road, Jarimari, Mumbai, Maharashtra, India – 400072 (“Ilumay”, “we”, “us” or “our”).
These Terms should be read together with our Privacy Policy, Shipping, Delivery & Refunds Policy (“Policies”). By using the Website, creating an account or placing an order, you agree to these Terms and Policies.
1. Eligibility and Accounts
By using the Website or placing an order, you represent that you are legally capable of entering into a binding contract. If you are under the age of majority, you may use the Website only under the supervision of a parent or legal guardian.
You are responsible for providing accurate information, maintaining the confidentiality of your account credentials and notifying us at hello@ilumayskin.com if you suspect unauthorised access. We may suspend or terminate accounts used fraudulently, unlawfully or in breach of these Terms.
2. Products and Product Information
We take reasonable care to ensure that Product information is accurate. However, colours, textures, finishes and packaging may appear differently in photographs or across devices. We may update Product formulations, packaging, components or presentation from time to time, subject to applicable requirements, and may modify or discontinue Products without prior notice.
3. Product Use and Individual Response
Ilumay Products are cosmetic products intended for external use in accordance with the directions and warnings provided. Individual responses may vary depending on factors including skin type, sensitivity, allergies, environment, manner of use and other products or treatments used.
You are responsible for reviewing Product ingredients, directions and warnings before use.
TO THE FULLEST EXTENT PERMITTED BY LAW, ILUMAY SHALL NOT BE RESPONSIBLE FOR REACTIONS, IRRITATION, INCOMPATIBILITY, REDUCED EFFICACY OR OTHER CONSEQUENCES RESULTING FROM MISUSE; USE CONTRARY TO DIRECTIONS; IMPROPER STORAGE; USE AFTER EXPIRY; ALTERATION, CONTAMINATION, DECANTING OR REPACKAGING; INCOMPATIBLE USE WITH OTHER PRODUCTS OR TREATMENTS; OR AN INDIVIDUAL ALLERGY, SENSITIVITY OR CONDITION NOT ATTRIBUTABLE TO A DEFECT OR NON-COMPLIANCE IN THE PRODUCT.
Information provided by Ilumay concerning skincare, ingredients or Product use is for cosmetic and general informational purposes and does not constitute medical advice.
Nothing in these Terms excludes any liability or consumer right that cannot lawfully be excluded.
4. Product Results and Claims
Product results, including those from instrumental, clinical, dermatological or consumer testing, relate to the methodology, participants and conditions of the relevant testing. Testimonials, photographs, reviews, before-and-after images and study results do not guarantee identical individual results.
Individual results may vary. Nothing in these Terms alters any express Product claim required to be substantiated under applicable law.
5. Orders, Pricing and Payment
Submitting an order constitutes an offer to purchase. AN ORDER ACKNOWLEDGEMENT OR PAYMENT CONFIRMATION DOES NOT, BY ITSELF, CONSTITUTE FINAL ACCEPTANCE. SUBJECT TO APPLICABLE LAW, AN ORDER IS ACCEPTED WHEN THE PRODUCT IS DISPATCHED.
Before dispatch, we may refuse, limit or cancel an order because of Product unavailability, pricing or promotional errors, payment issues, suspected fraud, inaccurate customer information, suspected unauthorised resale, abuse of our systems or promotions, legal restrictions or circumstances outside our reasonable control. Any payment received for a cancelled order will be refunded as required by applicable law.
Prices are displayed in Indian Rupees and other relevant currencies according to region and include applicable taxes where required by law. Delivery and other applicable charges will be displayed before purchase. We may change prices at any time.
WHERE A PRODUCT IS LISTED AT AN INCORRECT PRICE DUE TO A TYPOGRAPHICAL, TECHNICAL OR OTHER ERROR, WE MAY, TO THE EXTENT PERMITTED BY LAW, CANCEL THE ORDER OR OFFER YOU THE OPTION TO PROCEED AT THE CORRECT PRICE BEFORE DISPATCH.
Payments are processed using the payment methods and providers available at checkout.
6. Personal Use and Unauthorised Resale
Products purchased through the Website are for personal use unless otherwise agreed by Ilumay in writing. You may not purchase Products for unauthorised commercial resale or distribution, or commercially resell, relabel, repackage, decant, alter or represent yourself as an authorised Ilumay retailer, distributor or representative without our written consent.
Ilumay makes no representation regarding the authenticity, condition, storage or safety of Products obtained from unauthorised sellers or altered or removed from our authorised supply chain.
7. Promotions
Promotions, codes, samples, gifts and other offers may be subject to additional terms and availability. Unless stated otherwise, they cannot be redeemed for cash or combined with other offers.
We may refuse or cancel promotional benefits in cases of fraud, manipulation, exploitation of an error or other misuse.
8. Shipping and Delivery
Shipping methods, charges and estimated delivery periods are set out in our Shipping, Delivery & Returns policy. Delivery estimates are not guaranteed unless expressly stated or required by law.
You are responsible for providing accurate delivery information. To the fullest extent permitted by law, we are not responsible for delays, failed deliveries or additional costs caused by incorrect information, failure to accept or collect a delivery, or circumstances outside our reasonable control.
If carrier tracking records a shipment as delivered but you have not received it, you must notify us within 7 days so that we may investigate. Failed deliveries, redelivery and return-to-origin orders will be handled in accordance with our Policies.
9. Returns, Refunds and Replacements
ALL SALES ARE FINAL. SUBJECT TO APPLICABLE LAW, ILUMAY DOES NOT ACCEPT RETURNS OR EXCHANGES FOR CHANGE OF MIND, PERSONAL PREFERENCE, INDIVIDUAL SUITABILITY OR BECAUSE A CUSTOMER DOES NOT EXPERIENCE A PARTICULAR EXPECTED RESULT.
Where a Product is received damaged, defective, tampered with, leaking, incomplete or incorrect, or where applicable law otherwise requires a remedy, you must contact us in accordance with our Shipping, Delivery & Returns Policy. We may reasonably require photographs, video, packaging, shipping labels, batch information or other evidence necessary to verify a claim and may require you to retain the Product and packaging while it is assessed.
Products altered, contaminated, diluted, decanted, repackaged, improperly stored, misused or damaged after delivery will not qualify for a remedy where the claimed issue results from that conduct, except where required by law.
We may investigate and refuse fraudulent or ineligible claims and restrict future transactions associated with material or repeated abuse where permitted by law. Detailed eligibility requirements, reporting periods and procedures are set out in our Shipping, Delivery & Returns Policy.
10. User Content
If you submit reviews, photographs, videos, testimonials or other content directly to Ilumay for publication or brand-related use (“User Content”), you retain ownership of your rights but grant Ilumay a worldwide, non-exclusive, perpetual, royalty-free, transferable and sublicensable licence to use, reproduce, edit, publish, display and distribute that content in connection with Ilumay’s business, marketing, advertising, social media and communications.
You represent that you have the rights necessary to submit the User Content and permit its use. We may decline, edit for formatting or remove content we reasonably consider unlawful, misleading, fraudulent, abusive or infringing.
Merely tagging Ilumay or using an Ilumay hashtag does not grant us this licence.
11. Intellectual Property
The Website and Ilumay’s trademarks, logos, Product names, packaging, trade dress, photography, videos, graphics, copy, diagrams, educational materials, Website design and other proprietary content (“Ilumay Content”) are owned by or licensed to Ilumay and protected by applicable law.
You may use Ilumay Content only for personal, non-commercial purposes. Unless authorised by us or permitted by law, you may not copy, reproduce, modify, distribute, commercially exploit, license, sell or create derivative works from Ilumay Content.
12. Automated Access and Website Security
You may not use bots, crawlers, scraping tools or similar technologies to systematically extract or reproduce Website content or data without our written consent.
YOU MAY NOT USE ILUMAY CONTENT OR SYSTEMATICALLY EXTRACTED WEBSITE DATA TO CREATE A COMMERCIAL DATABASE, COMPETING PRODUCT OR DATASET FOR THE TRAINING, DEVELOPMENT OR IMPROVEMENT OF A COMMERCIAL AI OR MACHINE-LEARNING SYSTEM WITHOUT OUR PRIOR WRITTEN PERMISSION, EXCEPT WHERE SUCH RESTRICTION IS PROHIBITED BY LAW.
You must not use the Website unlawfully or fraudulently; attempt unauthorised access; introduce malicious code; interfere with its operation or security; impersonate another person; or infringe another person’s rights.
13. Third-Party Services and Privacy
The Website may use third-party payment, e-commerce, analytics, social-media and logistics services. To the fullest extent permitted by law, Ilumay is not responsible for independent acts, omissions or failures of third parties outside our reasonable control.
Our collection and use of personal information is governed by our Privacy Policy and applicable law. We may send communications reasonably necessary to administer your account, orders, payments, deliveries, returns and customer-service requests. Marketing communications will be handled in accordance with applicable law.
14. Website Availability and Disclaimer
We may update, suspend, restrict or modify the Website and correct errors or information where necessary.
To the fullest extent permitted by law, we do not warrant that the Website will always be available, uninterrupted, secure or error-free and will not be liable for temporary unavailability caused by maintenance, telecommunications failures, cyber incidents, third-party failures or circumstances outside our reasonable control.
Nothing in this section excludes any right or obligation that cannot lawfully be excluded.
15. Electronic Records
To the extent permitted by law, order, payment, account, communication, fulfilment, courier, delivery and system records generated in the ordinary course of our business may be relied upon as evidence of the relevant transaction or activity.
16. Limitation of Liability
Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.
To the fullest extent permitted by law, Ilumay and its directors, officers, employees, affiliates and agents shall not be liable for indirect, incidental, special, punitive or consequential loss arising from your use of the Website or purchase or use of Products.
Ilumay shall not be liable for loss or damage resulting from Product misuse; failure to follow directions or storage instructions; alteration, contamination, decanting or repackaging; inaccurate information supplied by you; independent third parties outside our reasonable control; or other circumstances outside our reasonable control.
17. Indemnity
To the fullest extent permitted by law, you agree to indemnify Ilumay, its affiliates, directors, officers, employees and agents against claims, liabilities, losses, damages and reasonable legal costs arising from your material breach of these Terms; unlawful or fraudulent use of the Website; infringement of another person’s rights; User Content submitted in breach of these Terms; unauthorised commercial resale or alteration of Products; or intentional interference with the Website or its security.
This does not require you to indemnify Ilumay for liability that cannot lawfully be transferred or excluded.
18. Force Majeure
To the fullest extent permitted by law, we will not be liable for delay or failure caused by circumstances beyond our reasonable control, including natural disasters, governmental action, changes in law, strikes, manufacturing or supply interruption, raw-material or packaging shortages, transportation disruption, cyber incidents or payment-network failures.
Where such circumstances affect an order, we may suspend, delay or cancel fulfilment, subject to any remedy required by law.
19. Suspension and Termination
We may suspend or terminate access to the Website or an account where we reasonably believe these Terms have been materially breached; there has been fraudulent or unlawful activity; our ordering, promotional, return or refund systems have been abused; our intellectual property has been infringed; or there is a material security or other risk to Ilumay or another person.
Rights and obligations intended to survive termination will continue to apply.
20. Governing Law and Dispute Resolution
These Terms and any separate agreements shall be governed by the laws of India.
Any dispute capable of being referred to arbitration shall be resolved in accordance with the Arbitration and Conciliation Act, 1996, as amended, with Mumbai, Maharashtra as the seat and venue of arbitration. The courts at Mumbai shall have jurisdiction, subject to applicable law.
21. General
We may modify these Terms by posting revised Terms on the Website. Unless otherwise required by law, changes take effect when posted, and continued use of the Website thereafter constitutes acceptance of the revised Terms.
Our failure to enforce a provision does not waive our right to enforce it later. If any provision is invalid or unenforceable, it shall be modified or severed to the extent necessary without affecting the remaining Terms.
Nothing in these Terms creates an agency, partnership, joint venture or similar relationship between you and Ilumay.
These Terms, together with the Policies and any additional terms applicable to a Product, promotion or service, constitute the agreement governing your use of the Website and purchases through it.
You may not assign your rights or obligations under these Terms without our written consent. We may assign or transfer ours in connection with a reorganisation, merger, acquisition, sale of business or assets or other lawful corporate transaction, subject to applicable law.
